Overview

Jackson & Campbell has a national reputation for excellence in it’s representation of insurers in insurance coverage matters. With nearly 40 years of litigation and counseling experience in complex disputes between insured and their carriers, our clients have come to rely on our dependable and prompt analysis and opinions, effective case strategy and coordination, and our case management systems and support.

Our Insurance Coverage lawyers serve as national or lead counsel in several hundred insurance coverage matters across the United States, involving both primary and excess policies. We have provided insurance carriers with representation in suits involving:

  • Asbestos, DES, silica, lead paint, Fen-phen, solvents, and other mass tort substances
  • Environmental
  • Personal and Advertising Injury
  • Occupational disease
  • Construction defects
  • Healthcare
  • Products liability
  • E-Commerce

These cases are brought in both state and federal courts and vary widely in size and scope. Some are single site/incident, single carrier cases with exposure in the hundreds of thousands of dollars. Others involve multiple site/multiple carrier cases with exposure in the hundreds of millions of dollars.

Dependable & Prompt Analysis and Opinions

A threshold stage often preceding coverage litigation is that of analysis and opinion by outside counsel. For more than twenty-five years, we have assisted insurance company clients through research of pending claims, in light of policy language and applicable case law (or the lack thereof); and by providing thorough, thoughtful, dependable analysis and recommendations. Frequently, this analysis and advice addresses cutting-edge and unsettled legal issues. We are sensitive to the time constraints inherent in this work, and respond accordingly to such assignments, supplementing necessary new research with reliance upon internal resources that we have collected and developed through our many years of coverage experience.

Effective CaSE Strategy & Coordination

As national or lead counsel, we are responsible for the day to day management and handling of the cases. In conjunction with the claims examiners assigned to the cases, Jackson & Campbell plans and prepares case strategy, conducts and responds to discovery, drafts all pleadings and briefs, conducts site and other case investigations, presents oral argument at hearings, participates in settlement negotiations and, if settlement efforts prove unavailing, tries the case to successful conclusion.

Case Management Systems and Support

We have developed a number of systems and procedures to serve our coverage clients in a highly efficient and cost-effective manner. We also have the most advanced computer programs designed for handling document intensive litigation, along with the computer capabilities to create charts, graphs and displays necessary for support of this type of litigation. We have access to state of the art legal research resources, including LexisNexis and Westlaw. Our library contains the most authoritative and respected insurance treatises.
